As you know, NIS 2 applies to essential and important units in various critical sectors, including in the water sector. To be even more precise, it is the specific activities that are actually carried out by the unit that are decisive for whether you are covered or not.
You can perhaps even speak of a reality assessment when determining whether you have activities in a sector that must comply with NIS 2: What do you actually do? There is thus less focus on how you are organized (public/private, parent/subsidiary company, etc.) than what you do.
But what if you carry out both activities that are covered and activities that are not covered? Here we have used municipally owned harbors to show what is done. However, the assessment will basically be the same for entities that have both covered activities and non-covered activities.
